Giving three Talaqs with the intention of one – How many does it constitute?

Question
My husband and I were experiencing problems in our marriage. My husbands and mines knowledge was limited as to what constitutes a divorce in Islam. I truly believed that one divorce was constituted by my husband saying ‘talaaq’ three times and as such had the opportunity to reconcile within the iddah period should that be the case. On that basis, my husband uttered the words ‘talaaq’ three times with the intention of it constituting one divorce. You should also note that I was on my menses at that time. We evaluated our relationship and within one month, me and my husband decided to get back together and reconciled. At this time, we had been advised that my husbands utterance of the word ‘talaaq’ three times constituted three separate divorces and as such we were no longer husband and wife with no opportunity to reconcile. We are unable to fathom this as due to our limited knowledge and my husbands intention not to irrevocably divorce me at that time that this looks the case based on what we have been told. Had we have known this at the relevant time, my husband would never have said the word talaq three times. We would appreciate some much needed guidance on our circumstances as the intention was not to pronounce three talaaqs, just one with the opportunity to get back together which we have now done.

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
At the outset, we wish to point out that the issue of Talaq pertains to Halal and Haram. A fatwa is an opinion that is given according to the question posed. A Fatwa does not make Haram into Halal and vice-versa. Your husband should fear Allah Ta’ala and decide accordingly.
In principle, if one issues his wife three Talaqs with different/separate words, for example; Talaq, Talaq, Talaq, without any intention, then that constitutes a Talaq Mughallaz (a permanently irrevocable divorce).
If he uttered three Talaqs in one word, for example he says; I issue you three Talaqs, that too will constitute a Talaq Mughallaz (a permanently irrevocable divorce).
However, if he uttered three divorces with different/separate words and he clearly intended to issue only one Talaq, but repeated the remaining two words as emphasis and not to issue a separate Talaq, then in this case one Talaq will take place.
You state “…with the intention of it constituting one divorce”
If the intention was clearly to issue only one divorce, then only one Talaq will take place.
However, we reiterate, your husband knows better what was his intention at the time of issuing the divorce. He should fear Allah Ta’ala as Allah Ta’ala knows his intention and he should decide accordingly.
Considering the complexity of your situation, we advise you to contact your local Ulama Judicial Committee who may even ask your husband to take an oath that his intention of the three Talaqs was one Talaq. [i]
Until then, you must severe all contact with your husband.

اگر اس نے طلاق کے الفاظ یا فقروں کی تکرار کی اور کہتا ہے کہ میری مراد ایک ہی طلاق کی تھی؛ البتہ میں سمجھتا تھا کہ تین دفعہ طلاق بولنے ہی پر ایک طلاق واقع ہوتی ہے اور مفتی کو اس علاقہ کے عرف کے لحاظ سے یہ بات درست معلوم ہوتی ہو تو وہ قسم لے کر ایک طلاق واقع ہونے کا فتویٰ دےسکتا ہے.
فتاویٰ دار العلوم زكريا ٤/٧١
سوال : ایک نو مسلم شخص کے خسر نے تین طلاقیں انگریزی میں اس سے حاصل کیں، جب کہ اس نو مسلم کو معلوم نہیں تھا کہ تین دینے سے کیا ہوگا، محض ڈر کی وجہ سے یہ الفاظ بغیر نیت کے کہ دیئے، تو ان الفاظ “انت طالق انت طالق انت طالق” سے کتنی طلاقیں واقع ہوئیں؟

الجواب : صورت مسئولہ میں صرف ایک طلاق رجعی واقع ہوئی، اس لیے کہ بعد والی دو طلاقوں سے نئی طلاق دینا مقصود نہیں تھا بلکہ ایک اور اور تین میں فرق معلوم نہ ہونے کی وجہ سے ویسے ہی تکرار کیا، لہذا دیانۃ تصدیق کی جائے گی، ہا اگر بیوی نے قاضی کے سامنے مقدمہ پیش کر دیا تو قاضی تین طلاقوں کا فیصلہ دیگا

اگر بیوی کو کئي طلاقیں کے اقرار کا علم ہو گیا تو اس شوہر کے ساتھ تجدید نکاح جائز نہیں لان المرأة كالقاضى، البتہ اگر بیوی کو حقیقت امر کا کامل یقین ہو اور اس کا قلب پورے طور پر مطمئن ہو کہ شوہر نے سینکڑوں طلاقوں کی جھوٹی خبر دی ہے، تو اس کا شوہر کے ساتھ تجدید نکاح کرنا جائز ہے، اس لئے کہ طلاق کی جھوٹی خبر سے قضاء وقوع طلاق کا حکم مظنہ تہمت ہونے کی بناء پر کیا جاتا ہے، چنانچہ وجود بینہ کی صورت میں یہ بناء حکم موجود نہیں، اس لئے وقوع طلاق کا حکم بھی نہیں لگایا جاتا ہے، اسی طرح عورت پر حقیقت حال واضح ہونے کی صورت میں اس کے حق میں مظنہ تھمت نہیں اس کے لئے حرمت بھی ثابت نہوگی، المرأۃ کالقاضی کا مقتضی بھی یہی ہے، اس لئے قضاء القاضي بعلمه میں یہ تفصیل ہے کہ خالص حدود اللہ میں جائز نہیں اور غیر حدود میں عند المتقدمين جائز ہے، متأخرين نے فساد زمان کی بناء پر اس کو نا جائز قرار دیا ہے، اس علت کا اثر صرف غیر کے لئے قضاء پر پڑتا ہے خود اپنے نفس کے لئے حکم معلوم کرنے پر اس کا کوئی اثر نہیں، لہذا اپنے لئے اپنے علم کے مطابق عمل کرنا جائز ہے
